What counts as an HMO

GOV.UK describes an HMO (house in multiple occupation) as a home rented to at least three people who are not one household but share the kitchen or bathroom. A mandatory licence is needed when five or more people from more than one household live there. Councils can also license smaller shared houses. Check with your council.

Shared house licensing guide

Rentap doesn’t apply for licences or decide whether your house is an HMO. Your council does. This isn’t legal advice.

Is my shared house an HMO?

Usually, if three or more people who aren’t one household share the kitchen, bathroom or toilet. A household is broadly a family. The legal test is in section 254 of the Housing Act 2004, and your council has the final say.

When does an HMO need a licence?

A mandatory licence is needed when five or more people from more than one household live there and share facilities. Councils can also require licences for smaller shared houses (additional licensing) or all private lets in an area (selective licensing).

Can Rentap remind me when my HMO licence runs out?

Yes. Add the licence to the house’s compliance calendar with its end date, and Rentap reminds you 60, 30 and 7 days before. A licence lasts up to five years.

Does it work for a small HMO with three or four tenants?

Yes. It works the same for three rooms or thirty. A four-room house is £8 a month after the free month.

Do my tenants pay to use Rentap?

No. Tenants you invite use it free to see their own rent and payments and to report repairs. Only the landlord pays.
